These Official Rules govern Restore Hyper Wellness sponsored sweepstakes promoted on social media and through other platforms and/or in-store and identified as subject to these terms in the applicable post, caption, landing page or other official promotional materials (the “Promotion” or “Sweepstakes”).
Restore Hyper Wellness studio locations are independently owned and operated locations. Participation in the Promotion is subject to these Official Rules.
By participating, each entrant agrees to be bound by these Official Rules and by Sponsor’s decisions, which are final and binding in all matters relating to the Promotion. Participation is subject to all applicable federal, state and local laws and regulations. Any entrant who does not comply with these Official Rules may be disqualified.
Prize details, including the number of prizes, prize descriptions and the approximate retail value of each prize, will be set forth in the applicable Promotion announcement. Prize availability is subject to change. Prizes are non-transferable and may not be redeemed for cash except at Sponsor’s sole discretion.
Any prize that includes or relates to medical services is subject to prior consultation, medical evaluation and approval by a licensed medical provider. No medical services will be provided unless and until the winner is deemed an appropriate candidate in the sole professional judgment of the licensed medical provider. Medical services, if any, are provided solely by independently owned and operated licensed medical practices only in coordination with Sponsor, and not by Sponsor or its affiliates.
Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. If a winner is not eligible to receive a medical service prize for any reason, including medical contraindications or provider determination, Sponsor will award an alternative non-medical prize of equal or greater value. Prizes will be awarded only if properly claimed in accordance with these Official Rules.
Winners are solely responsible for all federal, state and local taxes, fees and other costs and expenses associated with acceptance and use of a prize that are not expressly stated as included in the prize description. Sponsor may issue an IRS Form 1099 or other tax documentation to a winner as required by applicable law.
All prizes are awarded “AS IS” without any express or implied warranty, except as required by law.
Unless otherwise stated in the applicable Promotion materials, the Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old, or the age of majority in their jurisdiction of residence, at the time of entry. Employees, officers and directors of Sponsor, any Restore Hyper Wellness franchisee, or their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and each of their immediate family members are not eligible to enter or win. Sponsor reserves the right to verify eligibility and to disqualify any person who tampers with the entry process or the operation of the Promotion, uses automated or improper entry methods, or otherwise violates these Official Rules.
The applicable Promotion announcement will specify the promotion period, including the start date and time and end date and time (the “Promotion Period”), the method of entry and any entry limitations. No purchase is necessary to enter or win, and a purchase will not increase the chances of winning. Except as otherwise stated in the applicable Promotion announcement, entries must be received during the Promotion Period and in the format designated by Sponsor. At the end of the Promotion Period, Sponsor will select the potential winner or winners in a random drawing from among all eligible entries timely received. Odds of winning depend on the number of eligible entries received. Potential winners will be notified using the contact information or social media account information associated with the entry. Sponsor is not responsible for unsuccessful efforts to notify a potential winner.
THIS PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. SPONSOR RESERVES THE RIGHT TO LIMIT, MODIFY OR EXCLUDE PARTICIPATION IN CERTAIN STATES OR JURISDICTIONS AS NECESSARY TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.
THERE IS NO FEE TO PARTICIPATE, BUT ENTRANTS BEAR THEIR OWN COSTS AND EXPENSES ASSOCIATED WITH PARTICIPATION.
SPONSOR ASSUMES NO RESPONSIBILITY OR LIABILITY FOR: (A) LOST, LATE, STOLEN, UNDELIVERED, INACCURATE, INCOMPLETE, DELAYED, MISDIRECTED, DAMAGED OR GARBLED REGISTRATIONS, ENTRIES, URLS, OR EMAILS; (B) ANY INCORRECT OR INACCURATE ENTRY INFORMATION, OR FOR ANY FAULTY OR FAILED ELECTRONIC DATA TRANSMISSIONS; (C) ANY UNAUTHORIZED ACCESS TO, OR THEFT, DESTRUCTION OR ALTERATION OF ENTRIES OR REGISTRATIONS AT ANY POINT IN THE OPERATION OF THIS SWEEPSTAKES; (D) ANY TECHNICAL MALFUNCTION, FAILURE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR COMMUNICATIONS LINE FAILURE, REGARDLESS OF CAUSE, WITH REGARD TO ANY EQUIPMENT, SYSTEMS, NETWORKS, LINES, CABLE, SATELLITES, SERVERS, COMPUTERS OR PROVIDERS UTILIZED IN ANY ASPECT OF THE OPERATION OF THE SWEEPSTAKES; (E) INACCESSIBILITY OR UNAVAILABILITY OF THE INTERNET OR THE WEBSITE OR ANY COMBINATION THEREOF OR FOR COMPUTER HARDWARE OR SOFTWARE MALFUNCTIONS, FAILURES OR DIFFICULTIES, OR OTHER ERRORS OR DIFFICULTIES OF ANY KIND WHETHER HUMAN, MECHANICAL, ELECTRONIC, COMPUTER, NETWORK, TYPOGRAPHICAL, PRINTING OR OTHERWISE RELATING TO OR IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING, WITHOUT LIMITATION, ERRORS OR DIFFICULTIES WHICH MAY OCCUR IN CONNECTION WITH THE ADMINISTRATION OF THE SWEEPSTAKES, THE PROCESSING OF ENTRIES, SOCIAL NETWORKING POSTS, OR REGISTRATIONS, THE ANNOUNCEMENT OF THE PRIZES, OR IN ANY OTHER SWEEPSTAKES-RELATED MATERIALS; OR (F) ANY INJURY OR DAMAGE TO ENTRANTS OR TO ANY OTHER PERSON'S COMPUTER WHICH MAY BE RELATED TO OR RESULTING FROM ANY ATTEMPT TO PARTICIPATE IN THE SWEEPSTAKES. SPONSOR ALSO RESERVES THE RIGHT TO DISQUALIFY ANY INDIVIDUAL IT FINDS TO BE ACTING IN VIOLATION OF THESE OFFICIAL RULES OR IN AN UNSPORTSMANLIKE OR DISRUPTIVE MANNER.
IF A POTENTIAL WINNER CANNOT BE CONTACTED OR FAILS TO TIMELY RESPOND WITHIN THE TIME PERIOD SPECIFIED IN THE APPLICABLE PROMOTION ANNOUNCEMENT, IS DEEMED INELIGIBLE, FAILS TO TIMELY RETURN REQUIRED DOCUMENTATION, DECLINES THE PRIZE OR OTHERWISE FAILS TO COMPLY WITH THESE OFFICIAL RULES, THE POTENTIAL WINNER MAY BE DISQUALIFIED AND AN ALTERNATE WINNER MAY BE SELECTED. BY PARTICIPATING, EACH ENTRANT RELEASES AND HOLDS HARMLESS EACH OF SPONSOR, ALL RESTORE HYPER WELLNESS FRANCHISEES, AND EACH OF THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES FROM AND AGAINST CLAIMS ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT, USE OR MISUSE OF ANY PRIZE; PROVIDED, HOWEVER, THAT NOTHING HEREIN IS INTENDED TO RELEASE OR WAIVE ANY CLAIMS THAT CANNOT LEGALLY BE WAIVED UNDER APPLICABLE LAW, INCLUDING CLAIMS RELATING TO THE PROVISION OF SERVICES RECEIVED AS PART OF A PRIZE.
Except where prohibited by applicable law, by participating in the Sweepstakes, entrant agrees that: (i) any and all disputes, claims, or causes of action arising out of or relating to the Promotion or any prize awarded shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association in accordance with its applicable rules and conducted in Travis County, Texas; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys’ fees; and (iii) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrant further waives any right to a trial by jury and any right to participate in any class action or class-wide arbitration. All claims must be brought solely in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or rights and obligations of any entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard to conflict of laws rules.
Sponsor’s failure to enforce any provision of these Official Rules is not a waiver of that provision. If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Information collected in connection with the Promotion is subject to Restore’s Privacy Policy available at https://www.restore.com/privacy-policy. Except where prohibited by law, entry into the Promotion constitutes each entrant’s consent to Sponsor’s and its designees’ use of the entrant’s name, city, state, likeness, voice, statements and other submitted materials for advertising, promotional and publicity purposes in any media now known or later developed, worldwide, without additional notice, review, approval or compensation.
All references to “Dollars” or “$” mean United States Dollars. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, corrupted or misdirected entries, which will be disqualified. Proof of submission is not proof of receipt by Sponsor.
This Promotion may be promoted through one or more social media platforms, including Instagram or Facebook. The Promotion is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook or any other social media platform used in connection with the Promotion. By participating, each entrant understands that the entrant is providing information to Sponsor and not to any social media platform, and each entrant releases the applicable social media platform from any liability arising out of or related to the Promotion.
If entry requires use of a social media account, entrant must have or create a non-private account, if required for Sponsor to view and verify the entry, and must remain in compliance with the applicable platform’s terms of use. Entries that are not capable of being viewed, received or verified by Sponsor for any reason, including because of entrant’s privacy settings, platform restrictions or deletion of the applicable post or comment, may be disqualified.
Any content submitted in connection with the Promotion must comply with applicable law and must not infringe, misappropriate or violate any third-party rights or contain material that is unlawful, defamatory, obscene, offensive or otherwise inappropriate, as determined by Sponsor in its sole discretion. Sponsor reserves the right to remove or disregard any such entry and to disqualify the associated entrant.
Unless otherwise stated in the applicable Promotion materials, there is a limit of one (1) entry per person during the Promotion Period. Multiple entrants are not permitted to share the same email address, phone number or social media account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple or different identities, accounts, email addresses, phone numbers, bots, scripts or other methods may void that entrant’s entries and result in disqualification.
